Why I started MotoJustice
The day I started MotoJustice was a painful day for me as a rider because I had to tell a guy who had hired a bad lawyer that I couldn’t take over his case. I hated saying those words but I had no choice. His case was irreparably damaged by a “billboard lawyer”. So many people see those billboards and get sucked in by the promises of big settlements. As a rider and a lawyer, I saw the need for genuine motorcycle lawyers who are actually riders like myself who understand the intricacies associated with motorcycle cases, and that really care about riders because WE RIDE. It may seem trivial, but advocating for motorcyclists requires that your lawyer not think “it’s dangerous so you should have known better”. Writing accidents off as inevitable is what leads to lackluster performance and poor results.
The guy who I couldn’t help was named Kody and he had a very compelling claim. Unfortunately, the billboard lawyer he hired completely screwed up the case. Kody had decided to take a ride on a nice spring evening to unwind after work and to get some breeze on his face; he wasn’t drinking, he wasn’t high, he wasn’t driving recklessly. A local politician who had been drinking backed onto the highway in front of his watering hole and hit Kody. Kody flew into a muddy ditch and his bike skidded down the road, taking several tumbles. Kody was knocked out and his motorcycle was totaled.
When the police showed up, they saw that the local politician was the cause and that he had been drinking. They shuffled him away from the scene and wrote up a vanilla version of the accident. In an attempt to cover any tracks, they issued a ticket to Kody. They tossed it on his chest as they loaded him into the ambulance. Just recalling his story makes me mad, but what followed was worse. The billboard lawyer did absolutely nothing to investigate the case. Did billboard lawyer send an investigator to the bar to find out what happened? Of course not, that takes money and effort. Did they bother sending him to get real diagnostics of his injuries? Nope. And what’s worse, when Kody asked about his ticket, billboard lawyer said, “we don’t do criminal; handle it yourself.” So, Kody showed up in Court and, lacking legal expertise and proper representation, he plead guilty.
When Billboard went to make the “easy settlement”, the insurance company for the politician denied the claim. The issue of drinking and negligence never came up since nobody did any digging. The guilty plea convinced billboard to dump the case and sent Kody out into the world seeking help from anyone who would listen. I listened but, at that point, there was no way to help. When Kody left, I told my law clerk to sit and help me create an entirely new business dedicated to helping riders get quality representation. I wanted the word to get out that real motorcycle justice is available and to seek lawyers that know motorcycles. MotoJustice was born.
